Acceptable Use Policy

This Acceptable Use Policy ("AUP") forms part of the Platform Licence Agreement between Redsun Innovations Limited ("Redsun") and the Customer and governs use of the Redsun Recruitment Platform (the "Platform"). The Customer shall ensure that all use of the Platform by the Customer and its Authorised Users complies with this AUP.

1. Permitted Use

The Platform may be used only for legitimate recruitment-related activities, including:

  • publishing job advertisements;
  • managing candidate applications;
  • communicating with candidates and clients;
  • managing recruitment processes.

The Customer shall ensure that all Authorised Users use the Platform responsibly and in accordance with applicable laws.

2. Prohibited Activities

The Customer shall not, and shall ensure that Authorised Users do not:

  • use the Platform for any unlawful purpose;
  • upload, transmit or publish any material that is unlawful, defamatory, abusive, obscene or discriminatory;
  • publish job advertisements that are misleading or fraudulent;
  • upload or distribute malicious software, viruses or harmful code;
  • attempt to gain unauthorised access to the Platform or related systems;
  • interfere with the operation or security of the Platform;
  • probe, scan or test the vulnerability of the Platform;
  • use the Platform to store, transmit or process data in a manner that breaches applicable data protection laws;
  • use the Platform in a manner that excessively consumes system resources or adversely affects performance for other users;
  • use the Platform in any manner that is inconsistent with its intended purpose as a recruitment software platform;
  • use the Platform in a manner that could damage the reputation of Redsun or the Platform;
  • use the Platform to upload, transmit or distribute child sexual abuse material, content that incites or facilitates terrorism, or content that promotes violence against any person or group;
  • use the Platform in violation of applicable economic sanctions, export controls or trade laws, including those administered by the UK Office of Financial Sanctions Implementation (OFSI), the US Department of the Treasury Office of Foreign Assets Control (OFAC), the US Department of Commerce Bureau of Industry and Security (BIS) and the Australian Department of Foreign Affairs and Trade (DFAT);
  • permit access to the Platform by, or process the personal data of, any person or entity ordinarily resident in, or any government of, a country or region subject to comprehensive sanctions administered by any of the authorities referred to above;
  • use the Platform to engage in unlawful discrimination in recruitment, including conduct that breaches the Equality Act 2010 (UK), Title VII of the Civil Rights Act and related federal/state laws (US), or the Australian Human Rights Commission Act 1986, the Sex Discrimination Act 1984, the Racial Discrimination Act 1975, the Age Discrimination Act 2004 and the Disability Discrimination Act 1992 (Australia).

3. Data Use

The Customer shall ensure that all personal data processed through the Platform is handled in accordance with applicable data protection legislation. The Customer shall not:

  • collect or process personal data without a lawful basis;
  • upload personal data unlawfully obtained;
  • use the Platform to harvest or scrape personal data.

4. Recruitment Content

The Customer is responsible for all recruitment content published using the Platform, including:

  • job advertisements;
  • candidate information;
  • communications with candidates.

The Customer shall ensure that all recruitment activity carried out using the Platform complies with applicable employment and recruitment laws. Redsun shall not be responsible for the content of any recruitment material published by the Customer.

5. System Security

The Customer shall ensure that:

  • login credentials are kept confidential;
  • only authorised users access the Platform;
  • suspected security breaches are promptly reported to Redsun.

The Customer shall not attempt to:

  • probe or test the security of the Platform;
  • bypass authentication mechanisms;
  • access data belonging to other users.

6. Fair Use

The Customer shall not use the Platform in a manner that unreasonably interferes with the use of the Platform by other users. Redsun may impose reasonable usage limits to ensure fair access to the Platform.

7. Monitoring and Enforcement

Redsun reserves the right to monitor usage of the Platform to ensure compliance with this AUP. If Redsun reasonably believes that the Customer or an Authorised User has breached this policy, Redsun may:

  • suspend access to the Platform;
  • require the Customer to remove offending content;
  • take such action as reasonably necessary to protect the integrity of the Platform.

8. Updates to Policy

Redsun may update this Acceptable Use Policy from time to time. Where material changes are made, Redsun will notify the Customer.

9. Enforcement

Redsun may suspend or restrict access to the Platform where it reasonably believes that the Customer or any Authorised User has breached this Acceptable Use Policy. Such suspension may be implemented without prior notice where necessary to protect the Platform, other users or third parties.
